MUSEUMS, PROPERTY TAX EXEMPTION, AND FACILITY RENTALS - IMPORTANT ALERT!

In California, property used for free museums is exempt by the Constitution and museums that charge admission may qualify for the welfare exemption if they meet specific requirements. The following is one of the requirements: "Property is not used exclusively for the charitable purposes of museums if it is used for activities and facilities not related to the primary charitable purposes of museums and not reasonably necessary or incidental to those purposes." This language is reflected in the state’s county tax assessor’s handbook (see page 42 at http://www.boe.ca.gov/proptaxes/pdf/ah267.pdf).

In response to a recent ruling of the Board of Equalization, CAM has been informed that two museums have been accessed property tax because they rent sections of their museum for corporate or social events. Like many museums, these organizations allow for-profit and nonprofit entities to utilize sections of their facility for events in order to raise funds for their educational and exhibition programs. These are areas of their facility that would normally be considered integral to their charitable purposes. However, according to their county tax assessor, using these same areas of the museums for social or fundraising purposes compromised their property tax exemption. If county tax assessors start to reinterpret facility rentals as not “reasonably necessary or incidental” to the primary charitable purposes, it could have a significant impact; museums would use what money they do raise in facility rentals to pay property taxes.

CAM is monitoring this issue closely and exploring our options. Although this is not a widespread problem at this point, it is projected that revenue from property taxes will continue to decline statewide and that the state is facing significant budget shortfalls. In these tight economic times, it is quite possible that the state and county governments may start reinterpreting the welfare exemption for museums in order to raise revenue.

JOHN F. KENNEDY UNIVERSITY MUSEUM STUDIES PROGRAM TO RECEIVE 2008 CAMMY AWARD

CAM is delighted to announce that John F. Kennedy University’s Museum Studies program will be the recipient of the 2008 CAMMY Award. The CAMMY Award recognizes extraordinary museum supporters, professionals, and institutions that have made outstanding contributions to California museums. The award highlights the excellent work of an individual or group in one or more of the following areas: Leadership, Patronage, and Service to the Field. Past recipients include: the James Irvine Foundation; Huell Howser, Director/Producer of KCET's California's Gold; the J. Paul Getty Museum; the Institute of Museum and Library Services; the Hewlett-Packard Foundation; U.S. Senator Dianne Feinstein; and Ed Able.

The Museum Studies program at John F. Kennedy University is being recognized in the category of Service to the Field for the involvement of their alumni and faculty in museum associations and their commitment to furthering and strengthening the museum field, especially in California. Jim DeMersman, the President of CAM’s Board of Directors will present the award during the CAMMY Luncheon on Tuesday, February 26, 2008 at the CAM Conference in Fresno. The University's President, Dr. Steven Stargardter, and Marjorie Schwarzer, professor and chair of the Museum Studies Department, will jointly accept the award.

VOLUNTEERS NEEDED FOR THE 2008 CAM CONFERENCE

CAM is looking for volunteers for the 2008 conference, Seeds of Change: CAM in the Heart of California, at the Radisson Hotel & Conference Center in Fresno, California, February 25-28, 2008. There are many ways to volunteer, including being greeters, registrars, and session hosts. In addition, there are volunteer opportunities at a variety of times -- early mornings, lunches, and evenings -- throughout February 24 - 27, 2008.

Volunteering is exchanged for conference registration on a one-to-one basis. For example, volunteers who work a total of four hours or more in one day can attend the other half of that day for free. Or, exchange one full day of volunteering for a full day of attending the conference!

It ‘tis the holiday season – the time of year when many museums present holiday-themed programs, host employee or volunteer appreciation events, and decorate their lobbies or staff offices. According to some studies, over 90 percent of Americans celebrate Christmas. But, to some, this may exclude individuals and families that recognize Hanukkah, Kwanzaa, or other observances. This poses a dilemma for museums that may wish to appeal to the majority while being inclusive of all traditions. Has your museum made a conscious decision to incorporate Christmas traditions or avoid them?

CAM RECEIVES GRANT FROM THE JAMES IRVINE FOUNDATION
CAM is very pleased to announce it has been awarded a $50,000 grant from the James Irvine Foundation in support of CAM e-News and two of its upcoming conferences over a two-year period. This grant will support valued and effective professional services for the California museum field and expand these programs for the benefit of the association, the state’s 1,300 museums, and the communities they serve. Through the newsletter and the conference, CAM helps its members stay connected to the larger California museum community, increase their knowledge of the resources available to them, explore opportunities, and hone their skills. This, in turn, creates museums that are more relevant, stable, and effective organizations that better serve their communities and the state’s citizens. The Irvine Foundation’s support at this time will help the association build upon recent accomplishments and continue to expand participation in CAM’s program.

IMLS RELEASES STUDY ON YOUTH PROGRAMS IN MUSEUMS AND LIBRARIES
The Institute of Museum and Library Services (IMLS) has announced the release of
Museums and Libraries Engaging America's Youth: Final Report of a Study of IMLS Youth Programs, 1998-2003. The study, which is part of IMLS's initiative, Museums and Libraries Engaging America's Youth, examined Institute-funded programs for youth aged 9-19 and surveyed nearly 400 museum and library programs about their goals, strategies, impact, and outcomes. UVIC OFFERING MUSEUM AND CULTURAL RESOURCE ONLINE COURSES

2008 AAM MUSE AWARDS - APPLICATIONS NOW OPEN
Recognizing outstanding achievement in museum media, the American Association of Museums (AAM) Media and Technology Committee has announced the 19th annual MUSE awards competition. The 2007 MUSE Awards competition received nearly 200 applications from a wide variety of museums in North America, Europe, Australia, and Asia. Entries included audio, cell phone, and interactive handheld tours, interactive kiosks and multimedia installations, podcasts, blogs, games, Web sites, online collection and image databases, videos, and e-mail marketing campaigns. For the 2008 awards, AAM is expecting another exciting round of projects that reflect innovation in the museum media community. UNIVERSITY OF TEXAS ANNOUNCES NEW INSTITUTE FOR HISTORICAL STUDIES, SEEKS FELLOWS AND PAPER PROPOSALS
The Department of History at the University of Texas at Austin has announced the establishment of a new Institute for Historical Studies at UT-Austin. The first two year theme is “Global Borders,” defined very broadly, conceptually as well as geographically. The Institute is seeking four residential fellows for the 2008-09 year, and is also inviting proposals for papers related to the theme to be given at Institute workshops. The deadline for fellowship applications is February 15, 2008, and the deadline for the Call for Papers is April 15, 2008. FREE “ARTS TUNE-UP” IN LOS ANGELES ON JANUARY 12
Individual artists and small arts organizations are invited to attend a free “Arts Tune-Up” event on January 12, 2008 at the East Los Angeles Library. This free event is designed to connect participants with arts consultants, working artists, and administrators who can provide information and answer questions on a variety of topics, including fundraising, how to market and publicize art, information on new loan fund programs for artists and organizations, benefit opportunities for artists, training programs for artists and organizations, board development for arts organizations, arts education resources, and much more. While seasoned artists, arts administrators and board members are welcome to attend, the information is geared more toward those people who are earlier in their careers and are looking for some basic ideas to help them with the business side of their work. IMLS AND AASLH DISTRIBUTE THE FIRST FREE SETS OF THE CONNECTING TO COLLECTIONS BOOKSHELF
The Institute of Museum and Library Services (IMLS) and the American Association for State and Local History (AASLH) have announced the first shipment of the Connecting to Collections Bookshelf to 212 museum and library representatives who attended the national conservation summit in June 2007. A total of 2,000 free sets will be awarded by the end of 2008. Museums, libraries, and archives wishing to receive the IMLS Bookshelf can apply by means of a simple, online application. The first deadline was November 15, 2007, and awardees will be announced February 15, 2008. AASLH PERFORMANCE MANAGEMENT PROGRAM – MUSEUM AND HISTORIC HOUSE DEADLINES APPROACHING
The American Association for State and Local History (AASLH) is still accepting applications for its Performance Management program for museum and historic house visitor survey groups. The deadline for these two categories is January 15. Performance Management offers history organizations a new way to measure and analyze visitor satisfaction and opinions. Through the use of Performance Management’s tested survey instrument and resulting report, museums and historic houses can implement positive change and gain valuable support material for fundraising, marketing, program development, and strategic planning. IRS ISSUES UPDATES ON FINAL E-FILING REGULATIONS AND TEMPORARY E-POSTCARD REGULATIONS
The IRS has recently issued final regulations affecting large nonprofits and temporary regulations affecting small organizations. For large organizations, the IRS has issued finalized regulations regarding the e-filing requirements of tax-exempt organizations. These rulings only affect public charities that are required to file at least 250 returns a year and have $10 million or more in assets at year end, and private foundations that are required to file 250 returns a year regardless of their year-end assets. More information on e-filing is available at http://www.irs.gov/efile/article/0,,id=108211,00.html. For small nonprofits, the IRS has issued temporary regulations for the new Form 990-N. This form, also known as the e-Postcard, was introduced as part of the Pension Protection Act of 2006. Smaller tax-exempt organizations with gross receipts of $25,000 or less that don't file a Form 990 or 990-EZ will now be required to file a Form 990-N. HISTORY CHANNEL ANNOUNCES CALIFORNIA RECIPIENT OF SAVE OUR HISTORY GRANTS
The History Channel has awarded Save Our History grants to 27 institutions across the nation. As part of an ongoing national campaign that began in 2004, these grants fund innovative preservation projects designed to bring communities together, actively engage children in the preservation of their local history, and communicate the importance of saving local history for future generations. CAM would like to congratulate the only Californian grant recipient, the Petersen Automotive Museum, for a year-long research project called “The Lowrider Oral History Project: Youth Voices.” In collaboration with students at Garfield High School, this project will study and preserve the cultural and historical significance of Los Angeles’ native lowrider culture. IMLS CALLS FOR 2008 COMING UP TALLER NOMINATIONS
The Institute of Museum and Library Services (IMLS) is now accepting nominations for the 2008 Coming Up Taller awards that recognize and reward outstanding after-school, out-of-school, and summer arts and humanities programs for underserved children and youth. By honoring excellence in these programs, the awards promote a creative, engaged, skilled, and confident generation of young people. Eligible museums, libraries, performing arts organizations, universities, arts centers, community service organizations, schools, businesses, and eligible government entities are encouraged to participate. Recipients of a Coming Up Taller award receive $10,000 at a special ceremony in Washington, DC, an individualized plaque, and an expense-paid invitation to attend the annual Coming Up Taller Leadership Enhancement Conference. UPDATE: NEA AND ARTS EDUCATION FUNDING STALLED
Potential historic increases in funding for the NEA ($35 million, approved by the House in June) and Arts Education within the U.S. Department of Education ($3 million, approved by both Houses in their Conference Report) are in jeopardy as Congress and the White House face off over total spending for the current fiscal year. On November 13, the President vetoed the Labor-HHS-Education funding bill, which included unprecedented support for arts education funding and would have fully funded long-awaited research on the status of arts education in our nation's schools. FREE CRATES AVAILABLE – JANUARY 10 IN MILPITAS
The Computer History Museum is looking for a new home for 50 top quality crates of various sizes, and will host a first-come, first-served open house on January 10, 2008, from 8:30 am – 3:30 pm. Recipient must pick-up and assume all transport costs. A forklift driver will be available to assist. Most crates are forklift/pallet jack ready, but a few need blocks. Some have ¼” to ½” non-archival foam (some fully lined) and all need to be vacuumed. AAM OFFERS LEGAL ISSUES OF MUSEUM ADMINISTRATION WORKSHOP
The American Association of Museums (AAM), in partnership with the American Law Institute-American Bar Association (ALI-ABA), will host a three-day workshop on Legal Issues of Museum Administration. This workshop is intended to provide museum directors, administrators, trustees, legal counsel, and others who are concerned with museum operations, with an awareness of the legal problems and issues they will encounter. Although primary emphasis is on new materials, the course is structured so that considerable familiarity with the subject matter is not required. CALL FOR PAPERS: 1ST WORLD CONFERENCE ON GLOBAL CLIMATE CHANGE AND ITS IMPACT ON STRUCTURES OF CULTURAL HERITAGE
The International Council on Monuments and Sites (ICOMOS) has announced a call for papers for the first world conference on global climate change and its impact on structures of cultural heritage. The conference topics and themes are devoted to public and private buildings, churches, temples and other places of worship, memorials and monuments of all kinds, castles, lighthouses and towers, bridges, city walls and fortresses, pyramids, tombs and ziggurats, archaeological sites and any other cultural vestiges. All construction materials will be considered including earth, natural stone, masonry, timber, iron, steel, aluminum, fibres and synthetics. SMITHSONIAN OFFERS FELLOWSHIPS FOR ART AND ARCHAEOLOGICAL CONSERVATION
The Smithsonian’s Office of Research Training and Services (ORTS) has announced one-year fellowships for recent graduates of masters programs in art and archaeological conservation or for conservation scientists to conduct research and gain further training at the Smithsonian in the conservation of objects in its collections. The fellowship begins in the fall of 2008. A stipend of $30,000 is being offered plus allowances. The prospective fellow must first contact the conservator or scientist with whom he or she would like to work. If the potential supervisor confirms that candidacy is suitable, application must be made through ORTS. SCHOLARSHIP AWARDS AVAILABLE FOR VISITOR STUDIES CONFERENCE
Applications are now available for two award categories that support attendance at the Visitor Studies Association (VSA) Annual Conference, which will be held in Houston, Texas, from July 15-19, 2008. Applications are now available for the April Award and Student Scholarship Awards. Applications for both awards are due by March 1, 2008. The April Award supports attendance at the conference for a first time attendee who is new to the field of visitor studies (practicing for three years or less). NORTHERN STATES CONSERVATION CENTER OFFERS BASIC COLLECTIONS PRESERVATION COURSE
The Northern States Conservation Center will be offering its online basic course on collections preservation beginning in January 2008. An Introduction to Collections Preservation provides an overview of current preservation issues from environmental monitoring to collection cleaning, exhibit mounts and storage furniture. Participants learn about every aspect of the modern museum and how the building, staff and fixtures affect preservation. For details and to register, see http://www.museumclasses.org.

GRANT ASSISTANCE CONFERENCE CALL RESCHEDULED
The Institute of Museum and Library Services (IMLS) has rescheduled a technical assistance audio-conference call for applicants for its 2008 National Leadership Grants. The makeup date for the December 12 conference call is Friday, December 21 at 1:00 pm (EST). IMLS will also host a call on Thursday, January 10 at 2:00 pm (EST).The call will give prospective applicants an opportunity to ask the IMLS staff questions pertaining to the grant program. PERSONNEL NOTES
  • The Palm Springs Art Museum has appointed Dr. Daniell Cornell as their new Deputy Director for Art and Senior Curator. Cornell’s duties will begin in February. Currently, Cornell is Director of Contemporary Art Project and Curator of American Art at the Fine Arts Museums of San Francisco.
  • Ellen Gorelick, who turned a small history collection into a major attraction, is retiring as Executive Director and Curator of the Tulare Historical Museum. She will step down in March after 14 years in the job.
  • The J. Paul Getty Trust in Los Angeles has announced the appointment of Greg Britton as publisher.

GETTY FOUNDATION OFFERS PROFESSIONAL DEVELOPMENT GRANTS
The Getty Foundation supports a grant program designed to allow institutions to provide opportunities for conservation professionals, particularly conservators from countries where relevant training is not readily available, to acquire new skills. IMLS INVITING PROPOSALS FOR MUSEUM & LIBRARY PLANNING, EVALUATION, AND SHARING GRANT
The Institute of Museum and Library Services (IMLS) is inviting proposals for a cooperative agreement to increase the capacity of museum and library grantees to design and deliver programs that preserve cultural heritage, enhance learning opportunities, encourage innovation, and support the professional development of library and museum workers. The cooperative agreement will improve the museum and library fields' sharing of best practices and the Institute's ability to access and analyze IMLS project results and communicate their impact to the field, Congress, the Administration, and the general public. The application deadline is March 3, 2008, and the cooperative agreement will be awarded April, 2008. The grant award of up to $1 million will be active for 24 months beginning April, 2008.
